O que é Regime tributário e como escolher o mais indicado?
É através do planejamento tributário e fiscal que a empresa realiza o recolhimento correto de seus impostos, além de promover sua compensação adequada. O IPI, por exemplo, é a compensação pago na importação e o ICMS ST antecipado na aquisição de produtos de outros estados. Os regimes especiais de tributação são, também, meios da empresa buscar uma redução na sua carga tributária efetiva ou mesmo melhorar o seu fluxo de caixa.
Antes de falarmos sobre como escolher o Regime tributário mais indicado, precisamos saber quais são os 3 regimes mais utilizados no mundo contábil, confira:
Lucro Presumido
Lucro presumido: qualquer empresa pode aderi-lo. O IRPJ e a CSLL incidem sobre uma alíquota definida pela Receita Federal. Além disso, a empresa pode ser enquadrada se o seu faturamento anual não for superior a R$ 78 milhões.
Lucro Real
Assim como no lucro presumido, qualquer empresa pode aderir a esse regime, mas geralmente são empresas com faturamento superior a R$ 78 milhões e empresas com atividades do setor financeiro que aderem a esse regime. Suas alíquotas são calculadas conforme o confronto de receitas e despesas. E assim sendo, é necessário ter a organização da contabilidade.
Simples Nacional
Esse regime é tributado por anexos e depende se a atividade é permitida. Se for permitida, nesse caso muitas vezes o limite do faturamento e as alíquotas são menores.
Nesse regime a empresa pode faturar até R$ 4,8 milhões, com alíquotas reduzidas e são pagas em um único imposto (PIS/COFINS/IPI/ICMS/ISS/IRPJ/CSLL/INSS). Porém temos que lembrar que mesmo que seja muito vantajoso, para algumas atividades os valores podem ser maiores do que se enquadradas em outros regimes; um exemplo seria o INSS patronal e assim trazendo desvantagens desse fator pela opção ao Simples Nacional.
