PLANEJAMENTO TRIBUTÁRIO E FISCAL
Tributário. A tributação sobre o consumo no Brasil é uma das mais altas e complexas de todo o mundo. Enquanto na maioria dos países existe somente um tributo incidente sobre a cadeia de consumo, no Brasil acumulamos pelo menos 5 tributos, são eles: IPI, PIS, COFINS, ICMS e ISSQN. Para dificultar ainda mais a compreensão, a administração destes tributos é descentralizada, cabendo à União gerir o IPI, PIS e o COFINS, aos estados o ICMS e aos municípios o ISSQN.
Sendo assim, manter-se atualizado e seguro sobre a aplicação das normas tributárias é uma tarefa árdua para o empresariado brasileiro. O planejamento tributário, apesar de muito falado, é pouco colocado em prática pelos empresários na hora de tomar suas decisões. Não raras vezes as empresas deixam de recuperar seus impostos ou o recolhem a maior, por desconhecerem a aplicação da norma tributária.
É por meio do planejamento tributário que a empresa saberá se está recolhendo corretamente seus impostos ou promovendo a sua correta compensação. A título de exemplo das possíveis compensações, temos o IPI pago na importação e o ICMS ST antecipado na aquisição de produtos de outros estados. Os regimes especiais de tributação são, também, meios da empresa buscar uma redução na sua carga tributária efetiva ou mesmo melhorar o seu fluxo de caixa.
Tanto a União quanto os estados dispõe de regimes diferenciados de tributação que são concedidos a empresas que preenchem determinadas condições. Em Minas Gerais, por exemplo, é possível à empresa deixar de recolher o ICMS ST na importação de produtos, quando grande parte deste são vendidos para fora do estado.
Há, ainda, a possibilidade de redução da alíquota efetiva do ICMS para indústrias que desejam promover investimentos na expansão de seus negócios ou no desenvolvimento de novas tecnologias. Neste último caso, há chances da empresa conseguir, inclusive, a redução do ICMS para 0%, durante determinado período de tempo. Enfim, não resta dúvidas de que um correta gestão tributário é de suma importância para que uma empresa possa se desenvolver de maneira saudável e sustentável.
Portanto, caro empresário, enquanto o governo não põe em prática a tão prometida reforma tributária, o que lhe resta é buscar, dentro das brechas deixadas pela lei ou nos regimes especiais minimamente divulgados, uma forma de reduzir legalmente a carga tributária.
