O que é Elisão Fiscal?
Essa é uma estratégia contábil que busca reduzir a carga tributária de uma empresa, através da omissão do fator gerador do tributo. Ou seja, através de um planejamento é possível encontrar formas dentro da legislação para fazer essa manobra sem burlar o pagamento dos impostos. A sua forma clássica atende também pelo nome de planejamento tributário, momento no qual é definido o regime adotado para o recolhimento dos tributos.
Quais são as vantagens da Elisão Fiscal
Reduzir a carga tributária, ajuda a reduzir as despesas variáveis (que dependem do volume vendido) e aumenta a margem de lucro de uma empresa. Outra vantagem é que essa é uma manobra lícita que traz meios de reduzir ou eliminar impostos na sua empresa.
Quando ocorre a elisão fiscal?
Fundamentada em ações previstas na lei, como explicamos, é possível reduzir os gastos com os tributos de forma legal com as medidas:
- Redução na base de cálculo do tributo;
- Evitar a incidência do fator que gera o tributo;
- Postergar o pagamento tributário sem multas.
Sendo assim, sua empresa pode se beneficiar da isenção fiscal devido à lei de incentivo, dependendo do mercado que você atua, que é uma forma de incentivo fiscal da própria legislação. Em outros regimes, é possível adiar o faturamento que ocorre no final do mês, para o dia 1° do mês seguinte, ganhando assim, 30 dias a mais para pagamento de diversos impostos como PIS, COFINS e ICMS.
Elisão Fiscal é crime?
Não. Elisão Fiscal ou Economia Fiscal ou, ainda, Planejamento Tributário constitui no mecanismo jurídico legal que possibilita ao contribuinte suportar um encargo tributário mínimo (aproveitando-se das brechas da lei), ao realizar uma operação tributável da forma mais favorável possível para o contribuinte, sem violar o ordenamento jurídico nacional.
Quais são os Tipos de Elisão Fiscal?
Existem diferentes formas de praticar a elisão fiscal, mas existem dois tipos de elisão, no que se refere à lei:
- Decorrente da própria lei;
- Decorrente de brechas e lacunas da própria lei.
No primeiro, são as decisões que já estão previstas em lei em troca da redução dos tributos. É o caso dos incentivos fiscais, em que a lei, por si só, garante o benefício, como os Incentivos à Inovação Tecnológica (Lei 11.196/2005 ). Já no segundo, é uma questão de interpretação, ou seja, uma variável na decisão sobre as alternativas dispostas.
Exemplos de Elisão Fiscal
Uma empresa que muda sua sede para ter uma alíquota mais baixa não está descumprindo a lei, mesmo que isso seja apenas para reduzir o imposto.
No caso de uma sociedade que paga seus sócios com divisão de lucros e não pró-labore, não há lei que impeça isso, mesmo que o mais adequado seja usar essa função para os salários dos envolvidos.
Já para uma pequena empresa, considerando o Simples Nacional, existem atividades específicas que se beneficiam mais com o regime como o Lucro Real ou Lucro Presumido e, nesse caso, um contador poderá orientar a melhor opção.
Outro exemplo é aproveitar incentivos fiscais, como o caso da lei de incentivo à cultura.
Municípios, Estados e Governo Federal oferecem leis específicas em que a oferta de apoio e patrocínio de projetos culturais garantem a renúncia fiscal.
Minha empresa pode praticar elisão fiscal?
A sua empresa não só pode como é possível que já esteja utilizando esse recurso. Aliás, é desejável que esteja. Adotar elisão fiscal significa seguir as melhores práticas de gestão tributária, se valendo de permissões da lei ou omissões dela para reduzir o peso dos impostos no orçamento.
Mas como você já deve ter percebido, não é uma área pela qual um empreendedor comum pode se aventurar sozinho. Um bom planejamento tributário depende da presença de um bom contador, seja como profissional contratado ou terceirizado.
Se você tem esse tipo de apoio na gestão, como lembramos há pouco, é possível que a sua empresa já esteja se valendo da elisão fiscal e pagando menos impostos, ainda que você sequer perceba isso.
Por outro lado, se ainda não compreendeu o valor da contabilidade, não é indicado que se arrisque na linha tênue que separa a elisão da evasão fiscal. O domínio sobre o tema e a legislação aplicável a cada imposto é fundamental para alcançar uma economia efetiva.
Caso contrário, você corre dois riscos com boas chances de se concretizarem: adotar um caminho errado e acabar pagando mais impostos, ou infringir a lei e ter que arcar com todas as consequências desse ato.
Exemplos de elisão fiscal nas empresas
A elisão fiscal pode se dar tanto por apoio da própria lei, quanto de brechas nela. No primeiro caso, há um estímulo legal para que as empresas façam escolhas mais vantajosas para elas do ponto de vista econômico.
O clássico exemplo é a escolha do regime tributário. Se você tem uma pequena empresa, é bastante provável que considere o Simples Nacional como a melhor opção para economizar com impostos. E essa é uma decisão quase automática, tomada por vezes sem analisar a própria realidade do negócio.
Um contador atento, contudo, pode olhar para suas informações e perceber que a sua atividade se beneficiaria de outro regime, como o Lucro Real ou Lucro Presumido. Inclusive, se você é um prestador de serviços que integra o atual anexo V da Lei Geral das Micro e Pequenas Empresas, há boas chances de isso acontecer.
Nessa situação, a escolha pelo Simples só se justifica caso a folha de pagamento corresponda a pelo menos 40% ou mais do faturamento. Do contrário, quem tem menos funcionários acaba pagando uma contribuição previdenciária maior que a devida, considerando que o tributo vem embutido na alíquota única que incide sobre as receitas.
Vale lembrar que a escolha do regime tributário ocorre a qualquer tempo, na abertura da empresa, ou na janela de janeiro, mês no qual um negócio já existente pode modificar o formato de recolhimento de impostos.
Já quando a legislação é omissa, a empresa pode no máximo ser acusada de inteligência na gestão, não de ilegalidade. Conforme seu ramo de atuação, há brechas que permitem pagar menos impostos pela simples escolha do local de instalação.
É o que acontece, por exemplo, com o Imposto Sobre Serviços (ISS), cuja alíquota é de definição municipal. Assim, nada proíbe um empreendedor de mudar sua sede para a cidade vizinha, se ela pratica um percentual menor para esse tributo. É uma oportunidade que a ele se abre, sem que a decisão possa ser questionada.
Mas como você saberia disso tudo, não é mesmo? É por isso que a presença de um contador auxiliando a sua empresa é tão importante. Diferente de você, que entende muito da operação, mas pouco de contabilidade e tributos, esse profissional é o especialista. Diferença entre Elisão, Elusão e Evasão Fiscal
Como falamos, a elisão é uma forma segura e legal de reduzir os tributos devidos por uma empresa. Já a evasão é a sonegação fiscal, que usa falsas declarações, omite informações e outros artifícios ilícitos para evitar o pagamento de tributos.
Essa segunda consiste na adoção de manobras ilegais para não fazer os pagamentos devidos e é um grande problema enfrentado pelo setor tributário. Além disso, a diferença entre as duas está no momento da ação de cada uma. A elisão é adotada antes da ocorrência do fator gerador da obrigação tributária, já a evasão acontece depois, ao não declarar a venda ou não emitir nota fiscal, comum na prática de caixa 2.
